Hi all, My brother has had a case filed against him under IPC sections 417 and 419 by a police station, which is different from where we currently reside. He is now considering joining Wipro. During the background check, Wipro will verify criminal cases with the local police station near our home where there are no cases. I am concerned whether Wipro will discover the case filed in the different police station and if this will impact my brother's chances of joining the company. Your response is appreciated.

Background Verification and Employment Policies

Normally, background verification covers only past employment records, and the agency conducting the verification does not have the right to access personal records such as criminal cases. However, some companies may have an internal policy stating that an employee convicted of a criminal offense will be terminated from service. This rule applies to employees who join the establishment by providing a declaration that they will lose their job if convicted by a court. Therefore, if a declaration states that there are no criminal cases against the employee, but it later turns out to be false, the company, upon discovering that the employee concealed information during the hiring process, may ask the employee to leave. Consequently, there is a risk even if the background verification does not uncover any past misconduct or incidents.
