What is the purpose behind the transfer of employees' personal data to China? Is it for deputation to the Client's place or for permanent transfer to a foreign location? What personal data are you planning to transfer?

At the moment, you need to refer to the IT Act of 2000 (duly amended) to determine if you are in violation of the laws. I don't think we have strict localization laws at this time, other than for sensitive industries like banks, payment gateways, insurance, etc.

However, with the implementation of DPDPA, this could pose a significant issue and may lead to fines of up to ₹250 crores. Therefore, it is imperative that this practice be halted as soon as possible.
