Dear Professionals, if an employee returns after three days of being absent without notice, can the company consider allowing them to serve the notice period now?

Why not? It is a matter of only three days. Let him work and complete the notice period or till a replacement is made as you think fit. You can even consider the three days as leave with pay if he has sufficient number of leaves to his credit.

Dear Madhu Sir, this employee is searching a job in office hours, and he is in probation period he has planning to abscond after taking his salary but we hold his salary because we know his planning, and after this he approach us and said he is ready to serve notice period, He was absence 3 dats without informing us and his reporting managers also he has not pickup phone from his seniors, he did not response call and sms of his collogues, he just approach to release his salary, on the basis of his 3 days absence without intimation for 3 days can we treat him as absconded in our record

Hi,

In normal course such request will not be entertained by the Employers as the credibility of the employee had already gone when he/she absconded without information. Even if you are allowing to serve balance notice period ensure data security for the work handled by the employee and remove the employee from server access. Most probably that employee might had reported back for want of salary. So it is purely at the discretion of the employer.

In such scenario if you are turning down the request of the employee then as a employer you will be expected pay the employee one month salary as the employee is ready to serve notice period but you are denying.

I think the same matter was raised by somebody else or yourself. In your first post, you did not mention about a misconduct of doing personal work during office hours and using office infrastructure. In such occasions, you can initiate disciplinary action for that. Three days' absence from work cannot be treated as absconding from work. You can refuse to sanction his leave and mark the day as unpaid leave. But an employee will be declared absconding when he never returns but in this case he has returned after three days. You can issue a show cause notice and ask him why did not apply for leave in advance nor pick the phone, he may have excuses and you are suppose to get it in spirit.

Dear Friend,
You can mark absent the employee for the period of absence. Three days of absent without intimation means absent can't consider as leave. You can call for explanation,if it violation any rules of the company. Does your company consider any "absent period " as leave if have intimation?
It is better to consider his resignation from the date of his absent or ask him to pay in leu of notice.
