I worked at a company for over 2 years, but now I've been offered another job. The new employer wants me to start in 40 days, but at my current job, I have a 2-month notice period. I've already given 35 days' notice and asked to be released early, but they won't let me go. So, I want to leave anyway, but they won't give me an experience or relieving letter. However, my new employer has completed the background check, and I have a Form 16B and actual salary slips. I'm thinking of making a fake experience and relieving letter. Can you tell me if this is okay?

No, your BGV might be cleared in this company, but going forward, your BGV will be marked red as there might be an overlap of employment. Most companies conduct their BGV through the UAN portal. If your Last Working Day (LWD) and new joining date overlap, it will create a significant issue. It is advisable to serve the full notice period, especially as you have just started your career.

Please don't do that. Request some time from your new employer. By submitting a fake experience certificate, you will face issues with future employers. Also, if PF is involved, a mismatch in the last working day will occur, preventing you from transferring your current PF to the new employer's PF account. Absconding may provide temporary relief, but you will feel the consequences later.

Don't rush to join a new organization. Ask your new employer if they have a buyout option for you. If not, discuss the situation with your current employer to settle the matter. Ensure you obtain an experience letter from them. Be ethical when leaving and joining an organization, as it significantly shapes your professional personality and approach towards work.
