If an employee covered by ESi falls sick, he is expected to produce the sickness certificate from the ESIC. The employer will not pay for the days the employee is sick. The payment by way of sickness benefit will be paid to the employee directly by the ESIC. Therefore, for leave related to sickness the employer should not pay salary. This is the case with maternity leave and leave on account of employment injuries/ accidents. Medical leave is available only to those who are out of ESI coverage.
