Sir, The gratuity paid to me according to Karnataka KCSR rules is lower than the Gratuity Act rules. Is the gratuity calculated based on the gratuity or state civil rules? Please reply.

Hi, The formula for Gratuity is last drawn basic x 15/26 x number of years completed. You can check by yourself.

Gratuity payable to a government employee of Karnataka is covered by the Death cum Pension/Gratuity Rules of the state; it cannot be compared to the gratuity payable as per the Payment of Gratuity Act 1972. It appears you are governed by the KCS Rules, so gratuity as per the Death cum Pension/Gratuity Rules will be payable. If there is any discrepancy in it, then you can agitate for it. Otherwise, no claim can lie for gratuity as per the statutory scheme.
