I have a concern that my employer terminated me just after I returned from my sick leave. I was on leave for one month and rejoined on April 1st. They terminated me on the 4th, stating very arrogantly and abusively that I was not productive last month. Can I take legal action? Are there any ESI legal acts applicable for such situations?
ESIC and Employee Termination
ESIC provides medical coverage. There is nothing in the act that states whether you can or cannot terminate the services of employees.
You have not provided any details, so we cannot comment further. However, if you are a worker under the ID Act, then the company needs to follow the procedure for the removal of employees, such as holding a domestic enquiry.
