Hi, I am Jitendra from Rajasthan. I was working with XXX as a Store CCE. I met with an accident while coming home from the office in a transport roadways bus on 16 November 2019 (the bus crashed with a truck). I lost my right leg from the knee point with a big fracture in the femur of the same leg, also a fracture in my right jawbone, and my right eye was punctured with glass. Additionally, my right hand was crushed from the wrist part.
I underwent ten critical operations after the accident, with the last operation taking place in October 2020.
I had been working with Vodafone on the payroll of Queens Corp for the past five years continuously. We have a GPA claim policy in my salary slip, and I have been charged for this in every month's salary slip. Despite informing my Queens HR about my permanent disability GPA claim since July 2020 and sending the required documents more than twice, I have been told that it's not in their hands and will take time. Now, when I reached out to the New India Insurance Company regarding the claim through email with HR, the insurance company informed me that it's been two years since the accident, and they won't be able to settle the claim.
I have a record of all the documents sent, receipts, WhatsApp chats, email conversations, and scanned copies of documents.
I have spent over 37 lakh rupees on my treatment, and now we are paying 53k interest per month. The GPA claim is for 5 lakh rupees, and if it is processed, it will be helpful for me.
Please advise on what steps I should take next.

I am quite sad to hear about your accident. You can lodge a workmen's compensation claim against your employer with the ALC/DLC of your area where your office is located. Since the accident occurred while you were on the job, your employer is liable to bear the cost of medical expenses and compensate for the loss. Therefore, you need to file a case at the labor office for such a claim with all relevant documents. It would be better for you to seek the help of an advocate. There is no need to pursue the insurance representatives.
