I have resigned from my company that has a standard 3-month notice period, but I have only 1 month available to serve my notice period as I have to join somewhere else. This is written on my offer letter: "Upon confirmation of service (after successful completion of the probation period), the employment can be terminated by a 90-day notice by either side. The Company can terminate your employment by paying you in lieu of the notice period, salary for the period of notice, and in case you leave the Company without giving notice, the Company shall have the right to recover salary in lieu of the notice period from the amounts due to you or otherwise. MSI reserves the right to terminate your employment in case your performance, behavior, and/or conduct are found unsatisfactory during the probation period by giving a 30-day notice or compensation.
However, if you resign or give notice to the Company (during or after successful completion of the probation period), the management at its discretion may decide to waive the required notice period from you and relieve you at a convenient date, without any obligation to pay compensation in lieu of the remaining notice that you may have given."
I want to know if my manager does not agree on relieving me early, am I bound to serve 3 months?
