Amendments to the Tamil Nadu Factories Rules, 1950

The Labour and Employment Department of Tamil Nadu has issued amendments to the Tamil Nadu Factories Rules, 1950, on April 26, 2017. These amendments provide guidelines for employing women during night shifts in factories.

Key highlights of the amendment

1. The occupier of a factory is required to take steps to prevent acts of sexual harassment in the factory.

2. A complaint committee must be constituted to maintain a complaint mechanism within the factory and dispose of complaints in a timely manner with strict confidentiality. The committee must be headed by a woman familiar with issues of sexual harassment, and at least half of its members should be women, including representation from a non-governmental organization.

3. Women workers are allowed to raise issues of sexual harassment in workers' meetings.

4. The occupier must assist women workers affected by sexual harassment.

5. Proper lighting must be provided in and around the factory.

6. Women workers employed in night shifts must not be fewer than ten, and not less than two-thirds of the total strength of workers, with one-third of the supervisors/shift in-charge/foremen being women.

7. Sufficient women security must be provided at entry and exit points, and adequate work sheds for women workers employed in night shifts.

8. Separate dining facilities and safe transportation from the factory premises to the nearest point of their residence must be provided for women workers on night shifts.

9. Necessary medical facilities must be available at all times, with provisions for telephone connections for emergencies.

10. Boarding and lodging provided for women workers must be exclusively for women and under the control of women wardens or supervisors.

11. There must be at least twelve consecutive hours of rest between the last shift and the night shift when a woman worker is changed from day shift to night shift and vice versa.

12. At least two women workers per night shift should be appointed as Special Welfare Assistants.

13. Any untoward incident must be reported to the Inspector and the concerned police station.

14. These guidelines must be prominently exhibited so that women workers are aware of their rights.

15. Adequate toilets with water facilities must be provided, conveniently situated and easily accessible, containing all basic amenities and safety measures.

16. Creche facilities must be provided where needed, with caretakers and all essential amenities for the care of workers' children.
