Sir, I am a housekeeping and security contractor. Our Principal Employer is not accepting to pay full salary to all our workers for the lockdown period. The Principal Employer is saying that it is the responsibility of the contractor. Hence, I request you to give suggestions on how to proceed legally. I have paid full salary to all of my workers for the month of March.

Since you have already paid wages for the month of March 2020 to all workers, including the lockdown period, you have no option but to pursue the Principal Employer by writing a letter to request reimbursement. In the letter, quote government guidelines, and please ensure to forward a copy of the said letter to the labor officer of your area.

As the lockdown period is likely to be extended, it is essential to first obtain approval from the Principal Employer for reimbursement. Only if the Principal Employer agrees to reimbursement should you proceed to pay the workers. If any workers approach you for payment, advise them to file a complaint with the Labor Department. The Labor Department will take action on the Principal Employer, and only then will the Principal Employer reimburse the amount.
