I need help with this query relating to the fixation of minimum wages. Is HRA also inclusive of the minimum wage or not? For certain regions/states, the Government Order itself mentions that HRA is inclusive, but this is not the case on a pan-India basis. Typically, Basic + DA will be considered as minimum wages.
Some companies choose to use gross salary as their minimum wages, and they may have many salary components.
Please assist me with this. Thank you.

It would be wise, in my opinion, to keep Basic & DA as PF Gross, especially after the Supreme Court Verdict in February 2019 on PF Gross. There are State Acts on HRA where a minimum of 5% HRA is to be paid on Basic & DA, e.g., in West Bengal. Therefore, Basic + DA + 5% HRA may be the minimum wages for those states.
