Dear Team,
I have kept some documents from my previous company related to accounts. I was working as an accounts executive there. Due to official work, I have retained the documents with me. I left the job in March, and there is still an outstanding amount of Rs. 15,000 pending as part of my salary.
Would I be able to keep the documents until my salary is cleared by the employer? If yes, please let me know the procedure and if there are any relevant case studies.
Thank you.

How can one keep the documents of his previous employer after leaving his employment? If he feels it justified, the past employer can feel equally justified to withhold a part of his salary in view of his unauthorized possession of the documents belonging to the establishment even after his exit.
Always, give and take is the quintessence of any compromise between the disputants. Therefore, it is better for both of them to avoid such an attitude of tit-for-tat.
The poster may surrender the employer's documents forthwith and claim the unpaid salary. If there is any refusal, he may take appropriate legal action to recover his dues.
Similarly, the employer should disburse the dues to the ex-employee and insist on the immediate return of the documents in his unauthorized possession. If he fails, the employer may initiate criminal action against him.
