Dear members,

What is the maximum time an employer can take to complete full and final settlement of any employee?

I am asking this question because I had left my job after serving a 15-day notice period on the 10th of April '19. However, my employer has still not completed the full and final settlement.

In this case, what can I do? Please guide me.

Types of Dues at Termination

It depends on the types or nature of dues on the date of actual termination. If the termination is at the instance of the employer, such as discharge or retrenchment, notice salary has to be paid along with the orders of termination if sufficient notice is not given.

Payment Timeline for Termination

In any other case of termination of employment, including the above, salary for the period served up to the date of termination shall be paid on the next working day. The cash value of EL/PL/LWW can be paid within a reasonable time, such as in a week or 15 days. Gratuity, if eligible, should be paid within 30 days.
