Dear All, Recently, I joined a company in Gujarat. The company does not have certified standing orders. We are preparing for a BSCI Audit. How can we obtain certified standing orders for the company? Additionally, the company does not provide any CL or SL. The management in Gujarat claims that CL and SL are not compulsory. Is this really the case?

To obtain certified standing orders for your company in Gujarat and address the absence of CL (Casual Leave) and SL (Sick Leave) provision, follow these steps:

1. Certified Standing Orders:
- Review the Industrial Employment (Standing Orders) Act, 1946, which mandates certified standing orders for companies with a certain number of employees.
- Consult with legal experts or HR consultants well-versed in labor laws to draft and certify standing orders compliant with the Act.
- Submit the drafted standing orders to the Certifying Officer for approval and certification.

2. Casual Leave (CL) and Sick Leave (SL):
- Refer to the Gujarat Shops and Establishments Act or other relevant labor laws to determine the statutory requirements for CL and SL.
- If the laws mandate CL and SL provisions, communicate this to the management and emphasize the legal obligation to provide these leaves.
- Propose a leave policy that aligns with statutory requirements and ensures employees' rights are upheld.

3. Employee Communication:
- Educate employees about the certified standing orders once approved and ensure they understand their rights and obligations.
- Clearly communicate the introduction of CL and SL policies, if required by law, to all employees and provide necessary guidelines for availing these leaves.

By following these steps, you can establish certified standing orders for your company and ensure compliance with statutory provisions regarding employee leave entitlements.
