I joined in a engineering college as assistant professor. I feel that i want to resign the job. I am in probation of one year. I approached my head for resignation but he refused and told me to talk with senior person in the college. While joining they asked me the commitment in that they have written as 5 years commitment to work. Please guide me how can i resign from my current job.my head is saying that during probation i cannot resign.

This is purely based on the terms and conditions of appointment. The alleged 5 years commitment to work for 5 years is based on an agreement or only verbal. Notwithstanding the above factors, during probation, when Management has the right to terminate your service without notice, similarly you have also have a right to leave the Organisation.

If 5 years commitment is by an Agreement in writing,please check the clause that the five years period should be after successful completion of Probation period, mostly. If the clause says it is from the day of probation, then question of fixing probation one year period is no meaning, and the same can be challenged, the total agreement is one sided is void,. Consulate an Advocate.
