Please guide me. One of our employees went out of state for company work for 10 days. During those days, he met with an accident. Upon his return, he is on leave. I just want to know if this leave will be calculated as paid leave or not. Please guide me.

Paid Leave; I think company should bear all the expenses incurred for treatment as the accident happened while being on duty.

If the employee is covered under the ESI Act, then ESIC bears the leave salary and treatment. Otherwise, as per the EC Act, the employer has to bear the half-monthly compensation until the employee recovers and rejoins duty. For any loss in earning capacity, the employer will have to pay lump sum compensation, if applicable, as per the Act. More details regarding this matter would be necessary to provide an opinion.

Please comply with the senior members' advice and also find out the cause of the accident and the nature of the sustained injury. Ask the employee to provide all medical reports, whether he was hospitalized when the accident occurred or received any first aid. If the injury is serious, how did he return to his residence?

After receiving satisfactory and genuine reports/replies with supporting documents, check whether he truly requires rest for 10 days. If convinced, consider his case sympathetically.

As per the act, employee can get benefit from ESIC or company has to bear as per EC. Please check how the accident happened ! If any employee in takes alcohol then no amounts will be paid.
