I am currently working with the Ministry of Labour and Employment, Government of India as a Young Professional in the A Class Cadre. However, I have been deputed to a state government office where I am required to follow the office hours/days as per the state government regulations. Despite this, I am entitled to 8 casual leaves per year according to the central government rules, and my salary is being disbursed by the central government. I have several queries regarding my situation.
1) I am instructed to follow the state government's working hours/days but the leave rules are governed by the central government. Is this correct or legally incorrect? Can I challenge this decision?
2) State government employees are entitled to 12-15 casual leaves per year along with 6 additional medical leaves that can be carried forward (paid leaves). However, as a contractual employee of the central government, I am not granted the same benefits. Can a contractual central government employee request paid medical leaves? Also, is it possible for me to request permission from the central government to adhere to the state government's leave policies?
3) I was initially recruited under the Government of India's GIA for a period of 3 years and I am now in the process of receiving a 2-year extension. Can I seek regularization given that there have been no breaks in the contract renewal process?
4) Over the last 3 years, there has been a delay in receiving our salaries, with payments being made 8-9 months late. Since March 2017, we have been receiving our salaries on the 18th of every month. What actions can we take to address this issue?
5) It has come to my attention that we are not entitled to EPF/ESI benefits. Is this a violation of the law?
