I am a teacher in a private school, and I have been informed that I'm not eligible for gratuity. The reason given is that I joined in July 2012 and was on probation for 2 years. Therefore, I have not completed 5 years as a permanent employee. Is it true that I need to complete 5 years as a permanent employee to receive the gratuity amount?

Dear Ruchika,

As per the Gratuity Act, it states that you need to complete 5 years of service to be eligible for gratuity. However, it is not mentioned anywhere that the service should be after becoming permanent. You can request your HR department to provide or show the written communication where this requirement is stated.
