Some of our employees are asking to continue their ESIC contribution to provide ESIC medical benefits to their family members as they don't have any personal mediclaim, but employees have crossed the salary ceiling of 21k.

Please advise and provide the notification/clarification letter if any.

There is no provision for voluntary coverage under ESI in respect of employees who have crossed the ceiling limit of Rs 21,000/- per month. Such employees have to exit immediately, either from 1st April or 1st October.

Thanks sir. if employer continues the contribution wrongly for two half yearly period, can employee avail the benefit.

if employer continues his/her contribution knowingly further to keep the member alive in ESIC to avail the mediclaim facility.
