Hi,
I need to ask one thing. Whether female worker entitled for any leaves
1. If her company is not registered under maternity benefit act,
2. If company register under ESI but her income is more than 21000 per month. Coz of that she has not been covered under ESI.
3. Still company can give maternity leaves to her.

There is no registration etc under Maternity Benefit Act. The Act is applicable to all employees not covered under the ESI Act. In case of female employees drawing more than Rs.21000/- per month, benefits under the Maternity Benefit Act is to be extended

If the company engages more than 10 employees then maternity benefit act will be applicable to it and all female employees will entitled to benefits stipulated under the act.

Please find reply below :
1. If her company is not registered under maternity benefit act, - There is no registration required, it is compolsory to any company employs more than 10 employees.
2. If company register under ESI but her income is more than 21000 per month. Coz of that she has not been covered under ESI.
3. Still company can give maternity leaves to her. - She is entitle for all benefits under Maternity act. She is entitled for 182 days ie 26 weeks paid leave along with medical bonus before proceeding on leave.

Company is under obligation to give maternity benefit if your company by the effect of number employees is covered under MB Act. I should say that the employee can take it from you rightfully.
