As per provident fund rules, the date of leaving means the working day immediately preceding the last working day. So, the date of leaving is not a working day as per EPF wages act. This date indicates that from this date, the employer does not belong to the employer.

Practically, payment of wages/salary falls due when a person has worked. It is typically stated by the HR Head of the company in the Acceptance Letter of Resignation that you will be relieved from your duties on [specific date] after the close of working hours. In such a situation, the employee's attendance shall qualify him for payment of that day's salary along with his entitlements.

Dear Vanjee,

"Date of leaving" in the process of termination of employment would actually mean the date of relief from the organization. Whether that day would be taken into account for the purpose of salary depends upon the time of the day during which the employee is relieved. If it is forenoon, no salary should be paid as he comes just to get relieved from the job. If it is after noon, salary should be paid as he is relieved after the day's work only.
