Facing Workplace Challenges: Seeking Advice

I joined a company on 17th November 2016. After two days, I realized that the organizational behavior was not suitable for me. However, I continued my work by ignoring their behavior. After a few days, my boss started using abusive language towards me. At that time, I was only waiting for my salary. On 3rd December, he again used abusive language towards me, but this time it exceeded my tolerance level. I decided to confront him, but he ended up firing me. Now, the company is withholding my salary, and I am unsure of what steps to take. I believe all of this was pre-planned. I am from Delhi.

Handling Termination and Salary Withholding

"Organizational behavior was not good for me" is a very relative term and has no legal value. However, since you have been terminated, you can gladly accept such termination and demand salary for the days you have actually worked.

Wait for 10-15 days from the date of termination to get the final settlement. In the meantime, you can send a soft email asking them to pay the dues. Keep documentation of the email communication and use official IDs. If they don't pay after 10-15 days, then you can send a notice/legal notice through registered/speed post before taking further legal action.

Review Your Appointment Letter

You are advised to first glance at the terms and conditions of your appointment letter and check whether there is any clause relating to the notice period for leaving the company or termination of your services by the management. If such a condition exists, you shall be entitled to the pay for your notice period plus any pending salary. After verifying the above facts, you can take action as suggested by Sh. Ritesh Maity in his email.

Okay, let us sort out the issues. Let us know what type of company it is and what your job nature is. Also, who is abusing you? Here is an example: a car driver with irregular attendance leads to scolding by the employer. However, this case has not revealed any conclusions by us.
