Dear All,

As per the recent development in ECR uploading, the ECR will not be uploaded without UAN. The employee, while joining, fills out Form 11. If he does not have a UAN, the employer will generate his UAN along with KYC details and provide it to the employee for activation. The ECR will be UAN-based only.

Update on ECR Inundation Proposal

Mr. Vidya Dhar has proposed the inundation of ECR. It is currently in progress but has not been implemented as of today. Training has been provided to Assistant Commissioners in the IT departments of PF; however, training for the EDP cell of the department has not been conducted by the Assistant Commissioners. It is hoped that this will be applicable from the next financial year.

A procedure will be made available to employers on the EPF portal after training the staff of the EDP cell of the department. Time will be allocated for the public, i.e., employers, to understand this procedure. Therefore, I anticipate that this process may take some time.

The EPFO has cleared all the pending confirmations for previous employment processes and is allocating UANs to all members up to Oct 16 and Nov 16 for all establishments by Nov 25, 2016. Employers will provide the UAN to members and upload KYC for these UANs, and members will then activate the UANs.

Members are requested to transfer their previous PF to the current employer's new UAN. If the old UAN exists, it will become invalid in due course.

Therefore, I believe there will be no pending confirmations from Nov 16 to Dec 16. Let's monitor the progress by the end of Nov 2016.

I have a question regarding the following line: "The members are asked to transfer their previous PF to the current employer's new UAN. If the old UAN exists, it will be invalid in due course."

Most of the employees in our company have their old UAN, and I have already linked our PF account to the respective old UAN numbers. Please advise if I need to create a new UAN for them. What about mobile activation that is already registered in the UAN portal? Can I activate the same mobile number with the new UAN? EPFO does not allow a mobile to be registered twice.

Old UAN Invalidity Process

Old UANs will become invalid in due course. This means if a member has transferred their PF balance from the old UAN to the new UAN, the old UAN will automatically be invalidated by the RPFC, and an intimation will be sent to the member regarding the presence of two or more UANs.

These cases pertain to those whose cases were pending in the RPFC portal for confirming previous employment by the present employer. Such cases are cleared by the RPFC by allotting a fresh UAN. Accordingly, in this process, if any member has an old UAN and is allotted a fresh UAN, they will have to transfer the PF to the new UAN.

I have a question about the inundation of UAN. I have been allotted more than one UAN due to drawing a salary as a consultant from different companies. Would all the UAN numbers be consolidated? If so, how would my monthly contributions be updated?

Dear Mr. Anand,

Any member cannot work in two establishments at a time; it is an offense. Hence, the last UAN only will be the valid UAN. A consultant is not an employee; there is no relationship as an employer and employee.

Opinion on Consultants and Legality of Multiple Employment

I have a different opinion about the view expressed by Bhat regarding consultants and the legality of working for more than one establishment. There is nothing wrong with working for different establishments and receiving a "salary" from these various places. However, it should be a salary and not any other form of fees or retainer fees when it is subject to PF deduction. In most cases, the individual's designation will be Consultant, but they will be working as an employee. This is typically done to avoid PF deductions.

In the current situation, it is the opposite—a person is designated as a Consultant but is working as a part-time employee. In such a scenario, each employer is legally obligated to deduct and contribute towards PF. Additionally, in these cases, there will likely be more than one PF number, but you will have a single UAN, and the payments can be linked to that UAN.

Then I have a reverse case. One of my employees has transferred his PF from the New UAN to the Old UAN, and presently, the contributions are continuing in the OLD UAN. The reason he did this is that the DSC of the Employer (New UAN) was not registered in EPF, and it was not allowing me to link/transfer.

FYI, I did not allot him a UAN as he already had two UANs.

Please suggest.

Dear Mr. Ramesh,

The member has transferred his PF from the new UAN to the old UAN. Consequently, the new UAN will become invalid in due course. You have not allotted him a UAN, which means if you remain silent on the previous employer confirmation, the portal will allocate a new UAN. Please ask the member to transfer the active old UAN to the new UAN in your establishment.

Dear Mr. Vidya Dhar,

Until today, I have not received any communication from RPFC regarding the cancellation of the transfer of my accounts in One UAN number. November has passed, and December has begun. This means that the UAN-based ECR application may not be accepted starting from December as well.

No date is announced for new ECR filing process. However heard that fields in ECR are reduced to 11. PF number is not required but Gross Wage is a new addition
