Hello All! Actually, our company (software company) has a policy that an employee has to serve a notice period of 2 months, and this two-month salary will be provided in the third month after full and final settlement. I just want to confirm if this policy is correct or if it requires some changes. Employees have raised concerns that there is no such policy where the notice period salary will be provided after the full and final settlement. Can you specify any changes or share any notice period policy so that this doubt can be clarified?

Thanks,
Shubhangi

Hi, Shubhangi,

It is illegal to withhold the salary of an employee for the period they have worked. Many companies will pay the last month's salary along with F&F if the employee's last working day falls between any calendar month.
