Issue with Recorded Experience and Its Impact on Promotion
I am working in an Indian MNC. When I joined, my experience was 7 years, but by mistake, HR recorded it as 5 years, which caused a delay in my promotion. When I inquired about the delay in my promotion, the company realized its mistake and took one year to update my experience to 7 years. Although I now have 12 years of experience, my promotion and other benefits are equivalent to 10 years of experience.
When I asked my company for justice, they are neither accepting nor denying. This has been ongoing for the last three years. Now, I have lost my cool. I have all the evidence, including snapshots of my experience before and after the update, as well as email correspondence where they informed me of the experience update. I do not want to leave this company at present. What should I do to reclaim my benefits for the lost experience, which was a mistake of HR?

See, talk to HR and don't be so rigid, as you may not know when your employer will retaliate for your approach. Remember, you have very well mentioned that you do not want to leave this company. Actually, what benefit are you referring to? Was that a monetary benefit? Promotion in a private organization clearly lies in the hands of management/immediate supervisor/HR personnel, and you cannot fight for that, even though the same is mentioned in the "Career Development Policy" of the same organization. I am inquiring about the promotion that was delayed due to their mistake. This company has a rating system as well as a promotion system based on experience. My rating has been consistently top performer for the last 4 years. Despite having 12 years of experience, they are still paying me based on my experience as 10 years. After a stressful 2-year battle, they finally updated my experience to 12 years and admitted their mistake, but they are still not granting me the promotion. The company has a code of conduct policy that clearly states it will not tolerate any unfair treatment towards any employee in any form and it will adhere to professional ethics. In my case, the company has deviated from both of these principles. Should I escalate this issue to top management or is it advisable to pursue legal action?

The promotions and increments are not legal rights under various applicable laws and merely depend upon performance, attitude, discipline, company policies, and above all, the financial capability of the company.
It is my sincere advice not to consider any legal action against the company, as it will neither affect the company nor yield any fruitful results for you. Instead, you may find yourself in trouble due to such behavior. Since you have already spent 12 years with the company and also express an interest in continuing, it is better to approach the situation politely or consider a compromise.
