We have an employee suspended on the grounds of sexual harassment. The ICC found that it's a false allegation and terminated the lady. She never made any complaint to HR or her TL. However, she sent an email to the CEO of the company with some allegations. She didn't reply to our termination letter but filed a police complaint. After one month, she also filed a complaint with the labor commission. Now, we want to reinstate the services of the suspended employee. What is the procedure?

Greetings,

This is one of those unprepared situations that I am sure not even your ICC had prepared for. Please drop the charges against her. You will need a fresh inquiry. Get good counselors and consultants who have already handled such cases that backfired. Pre-wire the employee against whom the charges were put by the lady. This will bring in repercussions. Put that person under the radar of a neutral leader. Consult a lawyer on how to deal if the charges are revisited. Once your internal audit is strong, offer a fresh service/role to the lady. Once she joins in, keep a watch on the interaction and sensitize all your employees on the guidelines. Last but not least, please keep your corporate lawyer updated on this case to avoid a huge penalty.
