I am working in a Ltd Company. I have a 3-month notice period. However, every month I receive my salary on the 18th or 20th of the following month, and I have found that my salary is a condition set by my employer. I want to resign for this reason without serving any notice period. Can my employer file any case against me? What should I mention in my resignation letter to avoid any legal issues? Please advise.

Dear Sir,

Since you are a team member of your firm at present and have been serving for a definite period, it should have been communicated and reviewed by you at the time of joining regarding when you can expect to receive your salary.

After agreeing to the terms and conditions of employment, you cannot hold anyone else responsible. If you decide to change jobs, you must provide a written explanation for leaving, complete your notice period, and then you may leave.

You mean you know that the job is given with the understanding that you will get paid after the 25th? If that is not the case, then send your resignation, stating that you are resigning because salaries are being delayed. Due to this, you are unwilling to serve the notice period. I don't think you can do anything more.
