I am the proprietor of a small-scale service industry related to the telecom field located in Bangalore. Currently, there are about 5 regular employees on our payroll. We provide services related to telecom survey and installation.

I would like to inquire whether we need to register under the PF and ESIC act or if we are exempt from these formalities.

You mentioned having 5 regular employees on roles. What does this mean? Does this imply that the total employee count is only 5, or do you have other employees such as probationary or contract workers?

ESI & PF Regulations

In terms of ESI & PF regulations, it is explicitly stated that any form of employment, whether regular on roles, off-roles, or probationary, should be considered. Once the total employee count reaches 10, you are required to register for ESI, and for PF registration, you need a minimum of 20 employees. However, you can still opt for voluntary PF registration.

In case you are involved in providing support services to a company that is covered under PF & ESI, then by being a part of their activities and since they are compliant with statutory regulations, you will also be subject to PF & ESI contributions.

For ESIC Reqistration: It requires atleast 10 or more employess. For PF registration: It requires 20 or more than 20 employees. But u can register even though u don’t have that much of count.
