Guidance Needed for EPF & ESIC Subcode for New Factory Unit

We have a factory located at Kundli, District Sonipat, Haryana, for which we are registered under EPF & ESIC. We are opening another factory in District Gurgaon, Haryana. Do we need to obtain a subcode for both EPF & ESIC, or does our existing code suffice? Alternatively, do we need to acquire a subcode for EPF & ESIC for the Gurgaon unit?

I humbly request you to kindly provide me with the procedure and documents required for obtaining an ESIC Sub Code for a separate unit located in the same state (Haryana).

Information Required for New Factory Setup in Gurgaon

Sir, kindly provide information on the following points:

- Whether the new factory in Gurgaon has the same name and management as the old factory in Kundli, including partners, directors, etc.
- Whether the nature of production and activities is the same in both factories.
- Whether the new unit in Gurgaon will have the same financial entity, such as the same books of accounts and balance sheet, as the old unit in Kundli, which serves as the Head Office/Registered Office.
- Whether the location in Gurgaon where the new unit is established or being set up falls under the implemented area in terms of the applicability of the ESI Act.

I believe that if the answers to the above questions are affirmative, it would be most appropriate to approach the Sub-Regional Office, ESIC, Gurgaon, for the issuance of a Sub-Code for the new unit in Gurgaon.

Sir, first of all, I would like to thank you for your valuable reply.

Both factories (Gurgaon & Kundli) have the same name and management. However, both factories have a different nature of production. Both factories have the same system as far as financial matters are concerned. The ESI Act is applicable at the Gurgaon Factory.

1. Sir, you have not intimated whether the area in Gurgaon where the new unit has been set up is an implemented area. If so, you may contact SRO, ESIC, Gurgaon, with complete details of the coverage of the old unit at Kundli and request them for either the issue of a fresh Code Number for the Gurgaon unit or a sub-code Number as may be decided by them.

2. I may further inform you that, in my opinion, in case you try for a sub-code Number, the unit at Gurgaon will be coverable right from the date you employed the first person at Gurgaon, and contributions from the beginning till the current date will also be payable if employed. This will also include compliance in respect of all coverable employees, including at the construction stage, if any. This will depend upon the facts of your case. Therefore, you may discuss the issue personally with the officials and take action accordingly.

I have the same concern. If we have one organization in Delhi and two branches in Delhi itself, and we have already obtained the ESIC Registration, with the management being the same, the work being the same, and the state and location also being the same within a 10 km distance, do we need to take a sub-code or can we manage under the same code?
