I am in the probation period of 1 year at a PSU 'x' and I have executed a non-judicial bond with PSU 'x' to serve it for five years after probation. Now, after 8 months of joining PSU 'x', I have received an offer of appointment from a new PSU 'y'. What I am intending to do is resign from the previous PSU 'x' before joining the new PSU 'y'. However, I have not informed the new PSU 'y' about my previous employment nor have I informed PSU 'x' about my new job. Could this action on my part lead to any legal consequences?

If yes, then what would be an appropriate solution as I am very keen to join the new PSU 'y'? Also, I have to join the new PSU within 15 days. Please reply as soon as possible.

Thank you!

Before starting, I would suggest you consult with some legal experts.

Conditions to Consider

There are two conditions to consider in your case:
1. Your current employment
2. New employment opportunity

1. If you are not declaring your experience, then you are not entitled to take any benefit from it.
2. If you are working in the public sector, you have to complete a certain probation period, and there is an agreement and guarantee which you have to fulfill. If you run away from it, it will be considered a breach of contract, and you might be under legal scrutiny. Therefore, it is advisable to inform your current employer and follow the legal exit formalities.

3. If you are not disclosing your previous employment to your existing company, you are under a big legal problem because the industry is not aware of your past conduct. While filling out the joining forms, you have to declare any previous cases registered against you in any court or legal bodies.
