My name is Chandan Kumar Srivastava. I resigned from my last company on 17th November 2014. According to the company's policy, the Full and Final settlement will be cleared after 45 days, and the Provident Fund (PF) can also be claimed after 2 months. I submitted my PF on 5th February 2014. However, to date, the company has not closed anything despite several follow-ups. I have also sent a final email to the company requesting the closure of my Full and Final settlement and PF, but I have not received any communication from them.

Could you please suggest how I can expedite the process of receiving my dues?

You have issues regarding the settlement of your F&F and PF claim.

As far as your F&F settlement is concerned, you would need to follow up with your company itself. Try talking/meeting the concerned officials responsible for the same, check with them, and inquire about the reasons for the delay. Request them to settle it as soon as possible. If they do not listen or settle your account, you should approach the higher officials in the company (by following the usual escalation matrix). Make sure to put these concerns in emails in parallel so that it remains on record. These emails will serve as an official proof in case the problem is not resolved.

Regarding your PF claim, you should demand the acknowledgment slip from the company for submission to the PF Office. If they do not provide it, they may not have submitted the same to the respective PF Office yet. Kindly follow up with them on this matter. Even if the company continues to ignore your request and does not submit your claim forms to the PFO, raise the issue by email with the company officials. Send a few reminders as well (to keep a record). This evidence can be used when you escalate the matter to your group Assistant Commissioner at your respective PF Office requesting intervention. If the Assistant Commissioner is convinced that the company is deliberately withholding your PF claim, action will be taken. To convince him, ensure you have all email communications with the company.

Hi,

I already call them every day. Last month, I sent a letter informing them that if everything is not cleared within 10 days, I will take legal action. However, I have not received any communication from the company yet. I have also had a horrible experience with our company management – whenever I send an email regarding any issues, nobody really responds.
