Dear All,
Need your help.
We have a job contractor who engage carpenter on daily wages but in my company he has engaged carpenter who are now working at our premises with more than 15 years.
He is just paying him salary as daily wages and now not giving them any facility like offs etc as he had his view that he had engaged them on daily wages.
If i will go through their attendance records they are working for 30-31 days under the vendor with no offs.
Need to understand:- is there any provison in law if employee is working on daily wages than they are eligible for OFFS?
As they are working for years now under the same vendor still we can say them as daily wage earners? or they are now became the permanent employees and can ask for various benefits from the vendor?
Please suggest.

Sir,
1. Please intimate whether the records of the attendance and payment of wages in respect of said Carpenter are being maintained by the company or by the job contractor ?
2. If the records are maintained by the job contractor, then how company official say about period and attendance of said carpenter ?
3. Whether there are any written terms and conditions of engagement of such contractor employees with said Job Contractor ?

Please fine below response to your queries:-
1-attendance and payment records maintained by the contractor.
2-Once you are in the system, you start knowing about the people. One of the carpenter came to me with his issues. Knowing the fact some of them are working for years now.
3-I guess its no that the job contractor have issued them any appointment letter.
