Dear all, I have some clarification on the Factories Act, 1948. Please let me know:

1. Who has the authority to change the Factory Act amendments?
2. Does Tamil Nadu have a separate Factory Act other than the Tamil Nadu Shops and Establishment Act?

Please guide me.

Understanding the Authority on Labour Law Amendments

Labour is a subject under the concurrent list of the Constitution. The Factories Act is a central Act, which can be amended by both the central and state governments. An amendment by the central government will apply all over India. However, a state amendment applies only to that particular state. In case of a conflict between the central and state laws, the central law will prevail over the other. Shops Acts are state Acts that do not apply to factories.
