I submitted my resignation on 16th August 2013, and it has been accepted. As per the agreed terms, my notice period is 60 days, which expires today, and my relieving date is today, i.e., 15th October 2013. However, my management is not relieving me until they find a replacement. My new employer is also putting pressure on me. I want to be relieved in the next couple of days. Can anyone advise me on the legal aspects?

Regards,
Ram

Dear Member, this is a common problem nowadays that employers do not release an employee on the promised date. Sixty days are enough to find a replacement. If this situation continues for a longer period, your future employer may lose interest in you and decide to hire someone else.

In this case, please wait for this week. If things do not improve, then you may have a discussion with your HR/Immediate Supervisor. In the worst-case scenario, you can also schedule a meeting with your company's CEO/Board of Directors.

Meanwhile, send an email to your HR requesting to be released by the end of this week, keeping both your current employer and future employer in the CC. This way, they can also be aware of your situation.

Thanks & Regards,
