A married public sector employee can nominate another person as their PF and gratuity nominee, regardless of having a living spouse. If a child is nominated as a nominee, then who can be appointed as their guardian under the provisions of relevant acts such as the PF Act, Gratuity Act, and Banking Regulation Act?

Nomination of someone other than a family member will not be an issue as long as the employee is alive and will receive the PF and/or Pension amount personally. However, in the event of the nominee's death, the legal successors will be different. The court order will determine who the legal successors of the deceased employee are by issuing a "Succession Certificate."
