Legal Provisions for Non-Renewal of Contract Labour Registration in Maharashtra

Under the Contract Labour Act, the person employing contract labour needs to obtain a registration certificate that must be renewed every year. In the event that the registration is not renewed for two years, what are the legal provisions for the same in the state of Maharashtra?

Without renewing the RC, engaging the contract labor would make the employer liable for a fine and/or imprisonment. Without a valid RC, it would be challenging for the employer to prove that the contract laborers are engaged through valid contractors, and contract workers may claim permanency with the employer.

Thank you for your response. In our case, we applied for an amendment in the RC last year and requested a Challan for the additional contractor fees. However, the Challan was not provided to us for some reason. It has now come to our attention that the concerned officer is planning to issue a notice, as the period of all contracts has expired and they need to be renewed and updated on the RC.
