Clarification on New PF Rules

There is news that the PF rules would now include the entire salary and not just the basic salary. I am looking for clarifications on which salary components would be included when calculating the PF as per the new proposed rule.

Proposal to Re-Notify the Definition of 'Basic Wages'

The proposal to re-notify the definition of 'basic wages' under the Employees Provident Fund & Miscellaneous Provisions Act, 1952, suggests that allowances be clubbed with basic wages for the purpose of PF deductions.

As of now, this is just a proposal, and the notification has not yet arrived.

In the forum previously, we have talked a lot about this stated news. Since everyone should agree that the Matter of Surya Roshni Ltd. vs. RPFC Gwalior is still sub judice before the Supreme Court of India, let the judgment come, and only then can a conclusion be drawn. However, all should also agree that RPFC and various lower & high courts have no jurisdiction over the Supreme Court of India. Therefore, it is better to wait for the judgment rather than draw any premature conclusions that could misguide the forum.

The reference that was quoted several times, such as the office order from EPFO, is only an order of CPFC to their officials for the speedy disposal of cases that were pending under Section 7A of the EPF & Miscellaneous Provisions Act.

Thanks Mr Saxena and Mr Korgaonkar. We are just trying to some analysis on the change impact should this policy become reality. Hence was seeking clarity.
