I have been working in a private company for the past six months, but they are not paying the salary on time, so I returned to my hometown. I have emailed them asking for a leave of 10 days. I am considering sending a resignation letter. Can they take any legal action?

Have you checked within your organization for similar cases where an individual took leave, submitted a resignation letter, and did not return for duty? What happened to their F&F Settlement? Did the management waive off the notice pay for the resigned staff?

Normally, some private companies adopt the practice of withholding a portion of an employee's salary to incentivize them to stay with the company. While this practice is incorrect, many individuals do not speak out against it due to the prevalent issue of unemployment.

In addition to the points mentioned by Sharmila Das and S. Bhaskar, please also confirm if you have signed any bond with the company. If yes, what is the duration of the bond? Additionally, what is the notice period as per the appointment or offer letter? Providing more details will help focus the suggestions of the members.
