Clarification on Manpower and Factory License
I am Ramu, working in the manufacturing industry in Vijayawada, AP. I need clarification on manpower concerning a factory license.
Our factory holds a license with a maximum worker limit of 250. However, we engage 100 workmen per day across 3 shifts, including the general shift. My query pertains to compliance with the Factory Act regarding facilities such as restrooms, canteens, drinking water, etc. Should we consider the engaging strength or the approved manpower as per the factory license? I kindly request respected seniors to clarify my query.

Factory Worker Count and License Modification
The Worker in a Factory Act includes contract workers. Therefore, you need to count the total workers in the factory as per the muster roll.
Since you have more than 250 workers, you need to apply for a modification of your license to include a larger workforce. You will also need to do all the things needed for a factory with more than 250 workers (e.g., have a full-time medical officer).

Since you are engaging only 100 workmen (this includes everyone working in your premises, be it executives, supervisors, workmen, or contract labor), the compliances applicable to 100 only would apply. Licensed strength has no reference at this point for these matters.

As you have 250 workmen on license but are only engaging 100, the laws applicable will pertain to the 100 workers, not the full 250. However, the licensing authority may question you regarding the facilities you should be providing for 250 workmen when you are only hiring 100.
Please ensure you comply with all necessary regulations and requirements to avoid any issues.
Thank you.
