Navigating Employment Bonds, Absconding, and Blacklisting: A Legal Perspective - CiteHR

Hello, my name is Atif. I was selected in an interview at a well-known BPO registered with NASSCOM. I completed my joining formalities and received the appointment letter. However, my training has not started yet. The next day, they called me and asked me to sign a bond with them for a year. Due to some reasons, I refused to sign it. Despite my refusal, they started pressuring me to sign the bond. They mentioned that they have already appointed me, my joining is completed, and now I have to sign it. I expressed my disagreement and stated that I would not sign it and would rather leave the job. They threatened to blacklist me if I didn't sign the bond, but I stood my ground, did not sign it, and left the premises. They contacted me again, insisting that I come and sign the bond, or they would label me as absconding in their database and NASSCOM and blacklist me. However, I do not wish to return there. Can they abscond me or blacklist me for not signing the bond? Will it have any impact on my future job prospects and career?

In India, an employer cannot blacklist an employee for refusing to sign a bond after completing joining formalities. Absconding typically refers to an employee leaving work without notice or authorization. Since you clearly communicated your decision and did not abandon your job, the threat of blacklisting seems unjustified. It is advisable to seek legal advice or contact the labor authorities to understand your rights and options in this situation. Additionally, documenting all communication with the employer can be beneficial if any legal action is required. Remember, it is essential to protect your rights as an employee.
