I relinquished my services with an MNC catering company in February '12 after 7 years. When I requested the Gratuity payment, the HR department informed me that it was under process and would be done, but it has not been settled till now.
Now, after these many months, they replied to me saying, "We have been told by the authorities that they have stopped issuing cheques towards claim settlements, as per the recent directives of RBI. Instead, it is now mandatory for member establishments, such as ours, to open an account in the following name, in which the claim settlement amount would be credited by the trust. The account should be in the name of 'XXXXXX Hospitality Services Pvt. Ltd., Employees Group Gratuity Scheme/Fund'. We would also require a cancellation cheque and a bank statement of the above account to be submitted to P&G's Office of LIC, towards the realization of our gratuity claims."
I request the experts to please help me in this regard.

dear your company gratuity is insured under LIC Gratuity policy so as per direction of RBI they will directly send it into the company account and company will isssue a cheque to you

First of all, verify with the LIC Gratuity Fund office whether your name is included as a serving employee for the purpose of gratuity. If yes, no problem; obtain the necessary forms from them and submit them to your erstwhile employer for the gratuity payment. If your name is not on the LIC Gratuity Fund list, then you have to directly file your claim papers with your employer and wait exactly for one month. Thereafter, you are eligible to claim interest for the delay in the settlement of the gratuity amount.

Dear Sir, I worked for a public sector undertaking for 33 years. I applied for premature retirement, and the company accepted it on 2nd Dec 2006. Since the enhanced gratuity was applicable effective 1st Jan 2007, can I seek this enhanced gratuity having served the organization for such a long period?
