If someone is on leave for the entire month due to an extension in maternity leave granted as approved LWP, would that person get nothing for that month, or is she eligible to receive basic salary, medical benefits, and other expenses? What would the salary slip show?

The term LWP in Indian employment rules stands for Leave Without Pay, and hence no pay is admissible for the period an employee is on LWP, provided the absence does not occur during the 12-week period of maternity leave.

If an employee is on LOP for the entire month, he will receive nothing, implying he will not be eligible for medical or other allowances. The salary slip will show the salary breakdown in the first column, but in the column meant for salary earned, it will display 0, 0, 0, etc.

Hi, my query is does paid leave or casual leave accrue in case employee is on leave without pay for a long period like in the extended maternity or due to illness etc.?

It all depends on the company's internal policy. In the case of maternity, follow the act. Paid and casual leaves accrue depending on the company's leave policy. During illness, if an employee is covered by ESI, then paid and casual leaves lapse depending on the employee's service and the company's leave policy. If not covered, casual leaves also lapse as they are taken into consideration, and paid leaves will depend on the company's policy again.
