Hi All, Kindly guide me on this particular situation. I am going to hire a candidate who has been fired by the last organization, but she hasn't received any legal document from the company. She left the organization and hasn't reported to the office for the last 5 days. Now she has applied to our organization for a job. Her last organization is not ready to provide her relieving letter, and as per joining formalities, I need the relieving letter. She also doesn't have the resignation acceptance letter. Kindly guide me on all.

In that case, ask her to send the resignation letter by registered speed post and by mail. For mail, you may not receive confirmation, but with registered post, she will get an acknowledgment from the receiver. This method should be considered for submitting the resignation letter.

It's a strange situation when a prospective employer is aware that a candidate has been fired by their previous organization yet is still eager to find ways to absorb them. It is good that you are aware of this fact.

Although receiving acknowledgment by sending a resignation letter through registered post can serve as a useful document for proof, it does not necessarily imply acceptance of the resignation by the previous employer.

Why can't the candidate return to complete all the formalities and obtain a relieving order to escape from any legal hurdles?

If the previous employer refuses to provide the relieving order and you are in urgent need of the candidate, you can escalate the issue to the top management and request this requirement to be waived.
