Hi,

I have to frame a leave policy and a holiday calendar for the year 2012. I need to know the government law related to this. I would like to know the minimum number of leaves an organization needs to give to its employee. I believe there is no upper limit, but would appreciate if anyone shares the minimum number as per government law for giving CL, SL, and EL.

Also, what is the minimum number of holidays that are mandatory for an organization to give to its employees? Appreciate your replies at the earliest.

Warm Regards,
Vidhi

Hi Amit,

Thank you for the reply. The links you provided contain very old data. I would like to know the minimum number of leaves as per the current/latest Government Law. You mentioned 7 CL & 7 SL. Can you please confirm if this aligns with the latest government law?

My company is a private limited company involved in logistics. Please respond.

Dear Vidhi,

Greetings for the day!

First, you should know under which act your company falls, i.e., the Shop and Establishment Act in Delhi or the Factories Act. Accordingly, you can proceed with leave and holiday arrangements.

Hi Trupti, If I am not wrong there is no Shop & Establishment Act in Delhi. Well I have checked our company neither falls under Shop & establishment act nor in Factories act. Regards Vidhi

Dear Vidhi,

There is a Shop and Establishment Act in Delhi. There is no law with regards to holidays per se. In addition to a weekly off, there are 3 National Holidays. Other than these, it is up to the employer to give additional holidays. There is no minimum or maximum for this—you can say the minimum is 3 as there are 3 National Holidays.

In case you decide to follow the guidelines of the Delhi Shops and Establishments Act, then you may opt for 15 days PL/EL in a year (5 days after every 3 months) and 12 days CL/SL in a year (1 day for every completed period of one month).

Hope this information is of help to you.

Thank you for the information, Suresh.

In the Delhi Shops and Establishments Act, are we required to provide a minimum of 15 days of PL/EL per year (5 days after every 3 months) and 12 days of CL/SL per year (1 day for every completed month)?

Dear Vidhi, Yes. You may also check maternity leave which is also applicable. That is , in case your Co falls under the Act. Regards, Suresh Rathi

What if a company isn't giving any SL/CL leaves? Would that be fine? Is there any clause of minimum holidays? I mean, can a company club holidays and paid leaves together?

I have been observing many companies practicing such. They club holidays and PL and make its total as 21 and don't give any CL/SL. Is that fine?

Kindly advise.

Dear Vidhi,

According to my knowledge, your company will come under the Delhi Shops and Establishment Act, and the rules mentioned by Mr. Suresh are correct and applicable. However, if your management agrees, you can increase the number of holidays accordingly.
