Under the Factories Act 1948, all persons working within the premises are termed as "Workers". If this definition is correct, then the queries are:

1. How are the Management Staff and workers differentiated under the Act?
2. For which type of workers is overtime applicable?
3. If management staff are also considered workers, then why can't they claim overtime under the act?
4. What is the applicable limit per period of overtime defined in the Factories Act? To be specific, the applicable limit is hours of overtime fixed and the period is weekly/monthly/quarterly, etc.
5.

Please provide additional information or complete the last query.

Thank you.

Exemption of Supervisory and Management Staff Under the Factories Act

Read Section 64 of the Factories Act. This section provides for the State Government to define supervisory and management staff who will be exempted from the provisions of this chapter dealing with overtime and spread overs. Hence, those holding positions of supervisory and management will not fall within the purview of these sections.
