I joined a BPO and left after 10 days. At the time of joining, they took my signature on a service agreement for 6 months. It states that if an employee leaves before 6 months, they have to pay the cost of their training, which is up to 50,000. Now they are asking me for 50,000. When I asked HR how the cost could be so high for just ten days, she said it's the policy. I requested resignation, but they accused me of absconding and stated that they would only accept my resignation once I pay 50,000. I decided to leave without submitting a formal resignation. Will this impact my future employment prospects?

Legal Implications of Service Bonds

All service bonds are subject to legal proceedings. If I am correct, they must have mentioned in the bond that until you pay the amount for not completing the specified days of service, you cannot join another organization. In such a case, no company will hire you if you have a legal suit against your name.

It is true that an employee who agrees to the terms and conditions of an agreement is required to honor the agreement and needs to pay the amount as agreed if they break the terms of the agreement while it is in force. However, the employer is required to prove the amount spent on training the employee when it comes to job-related training. In your case, you mentioned that there is only a 10-day shortfall to complete the agreement period. Legally speaking, even if you do not complete the agreement period by 10 days and decide to leave the employer's services to join another organization, your company may file a case against you for the recovery of Rs 50,000. In such a scenario, you can offer to pay a certain amount to settle the issue amicably.

There is a point in the bond which states that if an employee does not serve the company for 6 months, they have to pay the amount that the company spent on their training, up to $50,000. When I asked HR about this, expressing my willingness to pay the actual amount spent on training, she insisted that I must pay $50,000. In the agreement, it is clearly written that the amount is up to $50,000, and in the short period of ten days, how can it cost $50,000?

I requested her to provide the expenditure details, but she refused and said they would consider me absconding because I am not paying the money.

Please advise on what I should do.
