Hi, none of my employees are interested in PF. Can anyone tell me how to write a declaration form stating none of my employees are interested in PF? I need to get bulk signatures to be legally on the safe side.

No legal responsibilities or rights can be written off with or without consent, either orally or in writing. PF will remain, and employees or employers do not have the right to refuse PF if the employees fall within the ambit of PF. If you want to opt-out of PF, then increase the salary of your employees to exclude them from the PF ambit, and no one will be required to pay PF. However, PF is a financially significant saving, and tax benefits are also applicable to it.

Dear child, you are adamant. To help you, pursue what is stated in the link/attachment. I hope you would be a little clearer. Unless you comply with these provisions, no declaration will help you avoid the liabilities. Not collecting and depositing the PF is a punishable crime involving fines and imprisonment.

Please explain to your management that PF is not on a voluntary basis; it is a statutory obligation. It should be deducted from the employee, and the employer's part should be added and deposited to EPFO.

Further, please explain to all the staff that PF is the only savings that will help them when they lose their earning capacity. Even in case of any untoward incidents, the family can receive the EPS Pension, which can be highly useful for the deceased employee's family members.

The PF amount can be shown as an Income Tax exemption under Section 80C of the Income Tax Act.

Dear Swathi Their is no Rule for exemption of PF, only if the employees is above 60, he can be exempted. PF is compulsory. regards Prashant
