Availing leave is a primary privilege for the employee. If the employee takes leave during the notice period, it should be approved by the relevant authority. Once the leave is approved, there will be no issues regarding it.

No During the Notice period No one can take leave But you have to pay all leave benifit to that in his/her F and F
According to the company, you are not allowed to avail leaves during your notice period. However, some companies provide a leave encashment policy. Through this policy, you can receive a certain amount in exchange for your unused leaves.

ok then what is the Last Working Day of that employee? if that is last december 2011 Then you have to pay the leaves to him/her because that is mandatory

Firstly, it purely depends on the policy of the organization, which is documented and shared with the employees regarding what the policy states.

I feel the issue of leave varies from institution to institution. I say so because in my institution, we have a policy on leave which states that no one accumulates more than 15 days at the end of the year. In this case, if there is a notice of separation, it is advised to plan your handover and exhaust your leave days before your last day. This has helped our institution from spending too much money on such packages. I hope it helps.

Yes, the undersigned totally agrees with Mahavirsingh. However, the question remains: do we need to worry about his/her balance leave? No SL or CL shall convert into encashment, only PL. It also depends on the company policy for the encashment of maximum leave (PL).
