Claiming ESI Benefits After an Accident

How can an employee claim the benefits of ESI after getting into an accident on the way to company work? Could you please specify how the employee can claim all the benefits of ESI? I would like to know all the details about this.

Dear Mr. Lakhan, For accident cases, you can admit the employee to the nearest hospital, preferably a government hospital. Immediately contact your ESI local office and file the accident report. Once they accept it, you can either keep the employee in the same hospital if they allow it, or you may have to shift them to the hospital prescribed by the ESI doctor.

Once ESI admits the case, you will receive all treatments free of charge without any limit. However, if the treatment requires admission to a specialized hospital, this also needs to be provided in writing by the concerned ESI doctor. Please note that immediate reporting of the accident is a must; otherwise, the employee will lose the claim.

1. From which day does an employee start getting ESI benefits? What if they meet an accident on the day of joining?

2. Is the employee's and employer's contribution towards ESI calculated on what is payable or what is actually paid? What happens if the employee is absent for the entire month?

3. Is the employee eligible to get ESI benefits post-retirement? If yes, for how long will they continue to receive this benefit?
